Help with disputes and complaints UK lendersThis is a practical advice service to assist individuals, partnerships, small businesses, and limited companies who have a dispute regarding lender's actions that appear unjustified. It is run by a former Bank Manager with over 30 years experience in banking, debt recovery, and debt counselling with both sides of the sector seen. Comprehensive practical knowledge has been gained in negotiations at all levels. All negotiations are carried out in a positive, practical and pro-active manner with a keen awareness of costs and the main objectives.

Banks, Finance Companies, and Building Societies do take actions, which cannot be justified and unless the action is defended then this can have a significant impact on the customer. DEBTWISE can under no circumstances offer Legal advice, which can only be given by a qualified solicitor, but every effort will be made to give practical help to Clients who feel they require assistance. Letters can be drafted for Clients if they wish to contact the Lender themselves or DEBTWISE can act on behalf of the client. The aim is always to produce and effective commercial outcome.

For advice an initial 'Assessment Form' should be completed or details e.mailed to adv@debtwise.co.uk. On the information given an Assessment and recommendation will be made. It will then be up to the client to decide whether to seek further help from DEBTWISE. The service is generally free as the aim is help people treated badly by lenders. The service is licensed to give debt counselling and debt adjusting under the 1974 Consumer Credit Act as regulated by the Office of Fair Trading.

COSTS : Whilst the aim is to provide a free service, there are limitations such as the nature of the complaint, the complexity and the likely additional costs i.e. If DEBTWISE need to consult solicitors. Practical advice will be given, and if DEBTWISE can assist then the Client will be advised accordingly. DEBTWISE cannot give legal advice. Normally replies are sent by email. In most cases where a detailed reply is required it will be necessary to see all correspondence, and if the case is taken up with the lender a written disclosure authority will be required by that lender in order to deal with DEBTWISE.

NOTE : DEBTWISE specialises in cases where the client believes a lender has acted unfairly or the client has been misled by their partner regarding debts, and the lender is taking action. DEBTWISE can help in composing letters to Lenders, Ombudsman and Solicitors.

IT IS STRONGLY RECOMMENDED THAT ANYONE WHO HAS A COMPLAINT THEY WISH TO PROGRESS, OBTAIN A 'DATA SUBJECT ACCESS REPORT' UNDER THE DATA PROTECTION ACT 1998 (THE NORMAL CHARGE IS £10) FROM THE LENDER. THIS FILE HELPS CONSIDERABLY IN MAKING AN ASSESSMENT.
