(THE FINANCIAL CONDUCT AUTHORITY IS THE REGULATORY BODY) www.fca.org.uk

These are all free, but require that any company complaints procedures are followed first. Refer to earlier information on 'How to Complain' and obtain British Bankers Association, Financial Conduct Authority, Finance & Leasing Association guides if unsure. If the complaint is not dealt with satisfactorily a 'letter of deadlock' should be obtained from the company you complain to enabling you to refer to the relative Ombudsman.

The time taken to investigate a complaint can vary considerably. Normally the Ombudsman decision is binding on the Company but not the person complaining, although in the case of FLA Arbitration it is binding on both. If the matter is already the subject of legal action a check will need to be made as to whether the Ombudsman can investigate. It is also wise to check to ensure the right Ombudsman is approached!! DEBTWISE can assist in drafting correspondence and if necessary act on behalf of the person complaining. Note: If a complaint has been sent to the FOS and is turned down by an Adjudicator, then ask for an Ombudsman Review, if you feel that the Adjudicator has made an unfair decision. Feel free to email details to adv@debtwise.co.uk if an opinion or practical advice is required.

Alternative Dispute Resolution. The Ombudsman Schemes are part of the way of resolving disputes without court action as is Formal Mediation although costs are likely to be incurred in the latter. The Financial Ombudsman Service link explains ADR http://www.financial-ombudsman.org.uk/publications/technical_notes/alternative-dispute-resolution.html

DEBTWISE may be able to offer free PRACTICAL (but not legal) advice about any Banking/Lending problems and disputes. Time may be of the essence in dealing with banks, and banks are occasionally reluctant to hold off any action while the Financial Ombudsman investigates!

SOLICITORS COMPLAINTS : Help offered to deal with complaints about service provided by solicitors. See The Legal Ombudsman website for information about what complaints they can look at. http://www.legalombudsman.org.uk/ Telephone 0300 355 0333
